Terms of Service
The terms on which you may use this website. For the interest list and the pre-opening information itself, see the Terms and Conditions.
1. Acceptance of these terms
By using stillhavnresort.com you agree to these Terms of Service. If you do not accept them, please do not use the site.
These terms are between you and the site owner, whose details are on the Legal Information page. They apply to every visitor, whether or not you join the interest list.
2. What this service is
This website is an informational site about a hotel and resort project in development on the fjord coast north of Bergen. It publishes the design as it currently stands and collects expressions of interest by email.
It is not a booking platform. There is no reservation system, no account, no payment processing and no transaction of any kind. Stillhavn Resort & Casino has not been built and accepts no guests. The status of the project, and the weight you should give to the information published here, are set out in the Terms and Conditions.
3. Intellectual property
All content on this site — the texts, the architectural visualisations and other images, the layout, the design, the graphics and the name and branding of Stillhavn Resort & Casino — is owned by the site owner or used with permission, and is protected by copyright and other intellectual property law.
Except as section 4 allows, you may not copy, reproduce, republish, distribute, sell, licence, adapt or create derivative works from any part of it without our prior written permission. Nothing on this site grants you any licence or right in our intellectual property by implication or otherwise.
4. Permitted use
You may read the site, print or save pages for your own personal, non-commercial use, and link to it from another site provided the link is fair, does not suggest an association or endorsement that does not exist, and does not place our pages inside a frame on another site.
Press and media may quote short extracts and reproduce images in reporting about the project, provided the images are credited and identified as artist's impressions of a project in development. For anything beyond that, write to [email protected]; we answer such requests.
5. What you may not do
You agree not to:
- scrape, harvest, crawl or systematically extract content from the site, or use automated means to collect it, except for ordinary indexing by search engines that respect our
robots.txt; - use the site's content to train a machine learning model without our written permission;
- attempt to gain unauthorised access to the site, its server or any connected system, or to probe, scan or test its security;
- interfere with the site's operation, including by denial-of-service attack, or by sending automated requests at a volume liable to impair it for others;
- introduce any virus, worm, trojan or other malicious code;
- reverse engineer, decompile or disassemble any part of the site, except to the extent that applicable law expressly permits it;
- use the site to send unsolicited commercial messages, or to impersonate us or anyone else;
- remove, obscure or alter any copyright or ownership notice;
- use the site for any unlawful purpose, or in a way that infringes anyone's rights.
6. What you send us
The interest list form has no backend: it prepares a message in your own email application, and nothing reaches us until you choose to send it. When you do send us a message, you confirm that what it contains is yours to send and does not infringe anyone's rights, and that it is accurate as far as you know.
We use what you send to answer you and, where you have consented, to send project news — nothing else. Your message is not published and is not passed to third parties for their marketing. The Privacy Policy explains the handling in full.
If you send us an idea or suggestion about the project unasked, we may use it without obligation or payment. We say so plainly because it avoids a familiar misunderstanding. Please do not send us anything confidential.
7. Accuracy, and our right to change the site
We take care that the site is accurate at the time of publication, but a project in design changes, and pages may become out of date between updates. Images are artist's impressions and planned figures are estimates.
We may change, suspend, restrict or withdraw the site or any part of it at any time and without notice, and we may correct or remove content that is wrong or outdated. We are under no obligation to keep any particular page, image or figure available.
8. External links
This site links to a small number of external resources, such as the Norwegian gambling help line and public authorities. Those sites are not under our control; we provide the links for information and do not endorse their content, nor are we responsible for it or for their privacy practices. Following an external link is at your own risk, and the policies of the destination site apply once you arrive.
9. Disclaimer of warranties
The site is provided "as is" and "as available". To the fullest extent permitted by law we make no warranty, express or implied, that the site will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the site or its server is free of harmful components.
No warranty is given that any planned facility, area, capacity, feature, licence or opening date described on the site will be realised as described, or at all.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill or anticipated savings, arising out of or in connection with your use of this site or your reliance on its content.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under mandatory consumer protection law. If you are a consumer, these terms do not affect your statutory rights.
11. Indemnity
If you use this site in breach of section 5, you agree to indemnify us against any claim, loss, liability or reasonable cost arising from that breach. This does not apply to ordinary use of the site by a consumer.
12. Termination of access
We may restrict or block access to the site, without notice, where we reasonably believe it is being used in breach of section 5 or in a way that threatens the site's security or availability. Sections 3, 9, 10, 11 and 15 survive any such termination.
13. Changes to these terms
We may revise these terms as the project develops. The current version is always the one published here, with its effective date at the top of the page. Changes take effect when published, and continuing to use the site after that means you accept the revised terms. We will not apply a change retrospectively to your disadvantage.
14. Severability and waiver
If any provision of these terms is found invalid or unenforceable, it is to be limited or removed to the minimum extent necessary, and the remaining provisions continue in full force. If we do not enforce a provision on one occasion, that is not a waiver of our right to enforce it later.
15. Governing law and jurisdiction
These terms are governed by the law of Ukraine, where the site owner is established, and disputes are subject to the jurisdiction of the Ukrainian courts.
If you are a consumer resident in the European Economic Area, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country. Consumers in the EEA may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
